Terms of Service

These Terms of Service ("Terms") govern your use of Kashend ("we", "us", "our") and our mobile applications and website (the "Service"). Please read carefully. By creating an account, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (16 in the EU) and capable of forming a binding contract to use the Service.

2. Your account

• You're responsible for keeping your password confidential. Don't share your account credentials.
• You're responsible for all activity that happens on your account.
• Notify us promptly at support@kashend.com if you suspect unauthorized access.
• One account per person; don't create accounts under false identities.

3. Acceptable use

You agree not to:

• Use the Service for any illegal or fraudulent purpose, including money laundering, tax evasion, or financial fraud.
• Upload malicious code, viruses, or attempt to compromise our infrastructure.
• Scrape, crawl, or otherwise extract data from the Service except through our official APIs and within posted rate limits.
• Reverse engineer or attempt to derive the source code of the Service, except as permitted by law.
• Resell, sublicense, or commercially redistribute the Service.
• Harass other users on shared lists or send threatening messages through Service features.

4. Your content

You retain ownership of all expense data, photos, voice recordings, and chat messages you submit ("Your Content"). You grant Kashend a limited, non-exclusive license to process Your Content solely to operate the Service (e.g., transcribing audio, scanning receipts, rendering totals).

You represent that you have the right to submit Your Content and that it doesn't violate any third-party rights.

5. AI features

Kashend uses third-party AI services (currently OpenAI) to transcribe voice, parse text, scan receipts, and power the chat assistant. These features:

• May produce inaccurate or incomplete output. Always review AI-suggested values before saving.
• Are not financial, legal, or tax advice. The chat assistant's responses are informational only.
• Send your inputs to the third-party service for processing. See the Privacy Policy for details.

6. Shared lists

• The owner of a shared list can invite, remove, and assign roles to members.
• Members invited as Editor can add and edit expenses; Viewers can only see them.
• When a list is shared, all members can see each other's contributions to that list.
• You can leave a shared list any time from Settings.

7. Service availability

We aim to keep the Service available 24/7 but make no guarantees. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for downtime, data loss arising from third-party outages, or temporary unavailability.

8. Termination

• You may delete your account any time from Settings → Delete Account. Deletion is immediate and irreversible.
• We may suspend or terminate your account if you violate these Terms, abuse the Service, or pose a security risk.
• Upon termination, your account data is deleted as described in the Privacy Policy.

9. Fees

The Service is currently free. We reserve the right to introduce paid plans in the future. We will give at least 30 days' notice before any new fees take effect.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT AI OUTPUTS WILL BE ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASHEND AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100.

12. Indemnification

You agree to indemnify and hold harmless Kashend from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Pune, Maharashtra, unless your local consumer law gives you different rights.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the new version with a revised "Last updated" date. If changes are material, we'll notify you in-app or by email. Continued use after changes constitutes acceptance.
